On August 1, 2006 @ 1:00pm Klamath Tribes Tribal
Court held its first court hearing. The Chief
Judge heard testimony in a juvenile dependency
matter, which was transferred from the State Court
system by Judge Roxanne Osborne.
This was a landmark day for The Klamath Tribes in
that numerous individuals have spent countless hours
over a 6 ½ year period working towards the common
goal of having their own court system to oversee
various judicial issues. At this time, Tribal
court is hearing juvenile dependency (including
adoptions and guardianships), delinquency, expulsion
diversion, child support and civil disputes.
New Ordinances have been passed regarding landlord
tenant and peacemaking court. Each of these
are currently being implemented.
On October 14, 2008 The Klamath Tribes Child Support
Enforcement Department was opened at the Klamath
Tribal Courts and is taking new cases, as well as
working on transferring existing cases from Oregon
State.
Currently the Klamath Tribal Judiciary is accepting
applications for Lay Advocates. Lay Advocates
who have passed the Klamath Tribes Bar Exam are
available to assist tribal members with Tribal Court
matters. Please inquire with the Court Clerk.
Are you interested in being on the Judicial
Commission? Per Ordinance, the Judicial
Commission is responsible for providing oversight
and policy direction to the Klamath Tribes
Judiciary.
Persons wishing to serve on the Judicial Commission
must possess the following minimum qualifications:

Be an enrolled member of the Klamath Tribes;

Be at least twenty-one years of age on the date
of appointment;
-
Not have been convicted of a felony or a
misdemeanor involving dishonesty or moral
turpitude within ten years from the date of
appointment;
-
Not be a member of the Tribal Council or running
for a position on the Tribal Council;
-
Be familiar with the Constitution and laws of
the Klamath Tribes;
-
Have a working knowledge of tribal government
operations.

The Klamath Tribes’
Tribal Courts is working on a planning project for
potential new construction of a Tribal Justice
Facility funded through the US Department of
Justice, for Bureau of Justice Assistance
Correctional Facilities Comprehensive Master Plan
Project Grant. A community assessment and
feasibility study of the community will be completed
to provide data on the communities need for a Tribal
Justice Facility located on Tribal land. If it
is found to be needed and desired, the grant also
provides funds for the architectural design of the
facility that would be specific to results of the
first two studies.

Assessing Community Attitudes Toward Building a
Justice Facility on Tribal Land
Complete the survey and be eligible to win over $500
worth of prizes!
The Klamath Tribes are surveying members of the
Tribal community about the feasibility of building a
justice facility on tribal land. A justice facility
is a detention center or jail designed to detain
youth or adult offenders. You have been selected to
complete the survey because you are a member of the
Klamath Tribal community.
All survey responses will be kept confidential.
Names will not be linked to data or findings. You
will be asked to provide your name and telephone
number in order to enter you in the drawing for over
$500 in prizes. The prizes will be awarded to 20
participants who complete a survey and provide the
appropriate information. Winners will be announced
by the Judicial Department on October 16, 2009.
The survey is intended for adults 18 years of age
and older. If you are an adult, your input is
greatly appreciated. The information you provide
will be used to help the Tribes decide if building a
justice facility on tribal land is feasible.
The survey site is safe and secure and participation
has been approved by the Klamath Tribal
